2.
Learned counsel for the accused-petitioners submits that the petitioners have been falsely implicated in this case. Learned counsel also submits that the accused-petitioners Saksham Khandelwal S/o Rajendra Khandelwal & Amol Chopra S/o Shri Pravesh Chopra are behind the bars since 30.12.2025 and 29.12.2025 respectively. Learned counsel further submits that there is no criminal antecedent against the accused-petitioners and conclusion of trial will take time. Learned counsel submits that the alleged offences are triable by Magistrate, so no fruitful purpose would be served by keeping the accused-petitioners in custody and therefore, prays that the accused-petitioners may be granted the benefit of bail under Section 483 of BNSS.
3. Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the accused- petitioners hereinabove.
4. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the accused-petitioners that accused-petitioners Saksham Khandelwal S/o Rajendra Khandelwal & Amol Chopra S/o Shri Pravesh Chopra are behind the bars since 30.12.2025 and 29.12.2025 respectively; there is no criminal antecedent against the accused-petitioners and the alleged offences are triable by Magistrate and trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case deems it just and proper to enlarge the petitioners on bail.
