According to petitioners, they are landless labourers and thus are entitled to allotment of land under Section 198 of Zamindari Abolition and Land Reforms Act, 1950. 3. Grievance of the petitioners is that piece of surplus land situate in Village Sitarampur, Tehsil Kashipur, District Udham Singh Nagar, which is meant for allotment to weaker sections and landless labourers, is being used for some other purpose, which is not permitted by law. 4. The relief sought in this writ petition is as follows: “Issue a writ order or direction in the nature of mandamus commanding and directing the respondents to restrain installing the pillar by plotting the surplus/ceiling land which is situated at Village Sitarampur, Khasra No. 104 or Village Kharmasi, Tehsil Kashipur District Udham Singh Nagar, which is declared surplus under Uttar Pradesh Imposition of Ceiling on Land Holdings Act 1960.” 5. Learned counsel for the petitioners submits that petitioners have made representation to District Magistrate on 2026:UHC:3944 28.03.2026, therefore he can be directed to take decision thereupon. 6. Learned State Counsel submits that he has no objection if the writ petition is disposed of in terms of prayer made by petitioners’ counsel. 7. The writ petition is, accordingly, disposed of with a direction to District Magistrate concerned to take decision on representation dated 28.03.2026 submitted by petitioners as per law, within six weeks from date of presentation of certified copy of this order.
