CRL OP(MD). No.14735 of 2026
ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences under Sections 120(B), 109, 465, 468, 471 and 408 of IPC in Crime No.25 of 2026, on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant is working as Manager in Jothi Finance (P) Ltd. The officials of Jothi Finance Pvt. Ltd., in collusion with the other accused, including some of the borrowers, created bogus title documents and without properly verifying the records, sanctioned loans to the huge extent of 1.63 crores. Hence, the present complaint has been registered. 3.The learned counsel appearing for the petitioner submitted that the petitioner's name is not found in the FIR. It is alleged that the petitioner's wife had borrowed a part of the loan amount, and she has also been granted anticipatory bail by this Court in Crl.O.P.(MD) No.12933 of 2026, vide order dated 06.07.2026. He further submitted that the petitioner is ready to cooperate with the investigation and he has no 2/7 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.14735 of 2026 previous cases. Hence, he prayed to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has no previous cases and the investigation in this case is still pending. Hence, he opposed to grant anticipatory bail to the petitioner. 5.Heard the learned counsels and perused the materials available on record. 6.Considering the rival submissions made on either side and the nature of offences charged against the petitioner and considering the
facts that though the value of the property is less, the officials of the finance company have played major role in this case and the investigation is pending and the petitioner's wife, who is the borrower of the loan, has already been granted anticipatory bail by this Court and the petitioner had only signed some of the loan documents either as a co- borrower or as a witness, I am of the view that custodial interrogation of the petitioner is not necessary in this case and hence, I am inclined to 3/7 https://www.mhc.tn.gov.in/judis
