1. This bail application has been filed on behalf of the petitioner under Section 483 of B.N.S.S. in connection with FIR No. 25/2016 registered at Police Station Sadar Dholpur, District Dholpur for offence(s) under Sections 143, 323, 341, 325 & 195A of IPC, in which charge-sheet has been submitted under Sections 147, 148, 149, 323, 341, 325, 195A & 120B of IPC and under Section 3/25 of Arms Act.

Learned counsel for the petitioner submits that the present matter pertains to bail jump. After getting benefit of bail, the petitioner went out of State for earning livelihood, therefore, he could not appear before the learned Trial Court on the concerned date and as such, on 04.04.2019, his bail bonds were forfeited.
Learned counsel further submits that the petitioner is in custody since 27.02.2026. Learned counsel also undertakes that the
[2026:RJ-JP:13861] (2 of 3) [CRLMB-4737/2026] petitioner shall appear before the learned Trial Court on each and every date as fixed by the Court and the petitioner shall not make any attempt to jump the bail again, therefore, in the interest of justice, the bail application of the petitioner may be allowed.
3. Per contra, learned Public Prosecutor vehemently opposed the bail application.

Taking into consideration the overall facts and circumstances of the case; as also the undertaking of the learned counsel on behalf of the petitioner that the petitioner shall appear on each and every date as fixed by the learned Trial Court. Hence, this Court, without expressing any opinion on merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application under Section 483 of BNSS is allowed and accused-petitioner Dinesh Kumar S/o Deewan Singh is ordered to be released on bail provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so.
6. It is made clear that the accused-petitioner shall not involve himself in any other offence(s) during currency of the bail and he shall mark his presence on 1st week of every month in the concerned police station.
7. In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application

8. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner.
