Petitioner, through the medium of this petition, seeks the following reliefs:- (i) Issue writ in the nature of Mandamus commanding the official respondents to renew and convert the arms licence of the petitioner from Form XI to Form-VIII for sale and keep as per the new Arms Rules, 2016 in the interest of justice, equity and fair-play. (ii) Issue writ in the nature of Mandamus restraining the official respondents from interfering into the peaceful running of the business of the petitioner and allow the Serial No. 175 2 petitioner to carry on business, trade without causing any unnecessary interference. 02. Learned counsel for the petitioner submits that despite the recommendation by District Magistrate, Jammu, with regard to conversion of Sale, Keep & Repair license No. Home/AR/22/S&K/Repair/97/J&K issued by Home Department from Form No. XI to Form-VIII for sale and keep and Form No. IX for repair, as per the new Arms Rules, 2016, to the Principal Secretary, Government of Jammu & Kashmir, Home Department, Srinagar vide No. 280/DMJ/2019 dated 31.07.2019, the respondent- Principal Secretary, Home Department, Government of J&K, has not dealt with the matter with regard to the request of the petitioner despite lapse of many years. 03. At this stage, learned counsel for the petitioner submits that the petitioner shall be satisfied, in case, the instant petition is disposed of at this stage, with direction to the respondent- Principal Secretary, Home Department, Government of Jammu & Kashmir to decide the matter, by treating this petition as representation, in time bound manner. 04. Ms. Nazia Fazal, Assisting counsel to Mrs. Monika Kohli, learned Sr. AAG, who is present before this Court, submits that the respondents are not averse to the plea for disposal of the case at this stage by directing the respondents to consider the matter. 05. In view of the submissions made by learned counsel for the petitioner and documents placed on record, the instant writ petition is disposed of at this motion stage, by directing the respondents to treat the instant writ petition as a representation and accord consideration thereto within three months 3 from the date a copy of this order, along with copy of the instant writ petition and the annexure(s) are made available to the respondents. The order of consideration, if any, so passed be forwarded to the petitioner. 06. Petition, is thus, disposed of, along with connected application(s).
