Choudhury, learned Counsel for the petitioner and Mr. P.K. Bora, learned Standing Counsel for Elementary Education representing respondent no. 1, 2, 3 and 5 and Ms. S. Konwar, learned Counsel for respondent no.4. By this application filed under order VI Rule-17 of the CPC, the petitioner has prayed for impleading the incumbent, who has joined at his place from where he was transferred to elsewhere as respondent no.6. It is stated by the petitioner that he was working as Block Elementary Education Officer and was first posted at Dhemaji from where he was transferred to Sonari and from the said place of Sonari to Dhakuakhana and the learned Counsels submits that the said transfers were in a very short period of time and further that there were no exigencies of service for such transfer. He further submits that his transfer order from Sonari to Dhakuakhana was at the instance of one Bidyut Gogoi, who was posted at Sonari in his place and as such he submits that said Sri Bidyut Gogoi would be a necessary party for adjudication of the instant case. In the said facts and circumstances, this Court therefore allows the impleadment. Page No.# 3/3 The petitioner has also submitted that he be permitted to file an amended writ petition to bring into records certain additional facts relating to his transfer. The same is also allowed. The petitioner is as such directed to amend the cause title and file the necessary application and on filing the same, the Registry will make the necessary correction in the CIS. I.A. is disposed of.
