G.P. for Assignment The Court made the following: 3 BSB, J W.P.No.17421 of 2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following prayer: “…to issue a Writ, one in the nature of a Writ of Mandamus or any other appropriate writ, direction or order declaring the action of the respondent No.2 in not deleting the petitioner land to an extent of Ac. 5.06 cents in Survey No.295 vide Katha No.851 situated at Somagatta village, Chilamathur mandal, Sri Satya Sai district (erstwhile Anantapur district) in pursuance to the petitioner’s online application No.TATTA012300104628, dated 21.02.2023 from prohibited list under Section 22-A(1)(a) by considering G.O.Ms.No.575, dated 16.11.2018 Revenue (Assigned-I) Department and violative of G.O.Ms.No.575, dated 16.11.2018 Revenue (Assigned-I) Department and violative of Article 14, 21 and 300-A of Constitution of India and consequently direct the respondent No.2 to delete the aforesaid land of the petitioner from the prohibited list and pass such other order or orders as this Court may deem fit and proper in the circumstances of the case.” 2. The petitioner is aggrieved by the inaction of the respondent No. 2 / District Collector, Sri Satya Sai district in deleting the subject land of the petitioner from the prohibited list under Section 22-A(1)(a) by considering G.O.Ms.No.575, Revenue (Assigned-I) Department, dated 16.11.2018. 4 BSB, J W.P.No.17421 of 2026 3. The learned Assistant Government Pleader for Revenue placed on record a copy of the written instructions of the respondent No.4 vide Rc.No.149 /2026 / A, dated 08.07.2026, wherein it was stated as follows: “1. xx xx xx 2. The lands in R.S.No.295 admeasuring Ac.15.72 cents, situated in Somagatta village, Chilamathur mandal, Sri Sathya Sai District, are shown in the relevant records as lands originally assigned in favour of T. Adhigadu. The petitioner claims title through registered sale deeds of the year 2008 and relies upon the plea that the original assignment was prior to 18.06.1954. 3. xx xx xx 4. The mere fact that the petitioner has made a claim that the original assignment was prior to 18.06.1954 does not by itself result in automatic deletion of the land from the prohibitory list. The competent revenue authority is required to verify: (i) The original assignment records; (ii) The conditions of assignment; (iii) The subsequent revenue entries; (iv) The title flow and alienations; and (v) The applicability of G.O.Ms. No.575, Revenue (Assignment-I) Department, dated 16.11.2018.” 5. The petitioner submitted Mee-Seva Application No.TATTA012300104628, dated 21.02.2023, seeking deletion of the subject lands from the prohibited properties list. It is submitted that such an application 5 BSB, J W.P.No.17421 of 2026 can be considered only upon due verification of the connected original records and after examination by the competent authority in accordance with law. 6. While the Tahsildar and the Revenue Divisional Officer (R.D.O.) have made recommendations for deletion, these field–level recommendations do not by themselves confer any enforceable right upon the petitioner unless and until a final order is passed by the District Collector, who is the competent authority, after full verification of the record. 7. xx xx xx 8. xx xx xx 9. xx xx xx 10. No final order rejecting the petitioner’s request has been passed by the District Collector….” 4. In view of the above written instructions, the learned counsel for the petitioner requested to direct the respondent No.2 / The District Collector, Sri Satya Sai district to dispose of the application of the petitioner within the time fixed by this Court after considering the recommendations of the respondent No.3 / The Revenue Divisional Officer, Penukonda Division; and the respondent No.4 / The Tahsildar, Chilamathur mandal, Sri Satya Sai district. 5. Accordingly, the Writ Petition is disposed of directing the respondent No.2 / The District Collector, Sri Satya Sai district, to dispose of the application of the petitioner, as per law, within two (2) months from the date of receipt of a copy of this order, by duly considering the recommendations of the respondents No.3 / The Revenue Divisional Officer, Penukonda Division and the respondent 6 BSB, J W.P.No.17421 of 2026 No.4 / The Tahsildar, Chilamathur mandal, Sri Satya Sai district and communicate the decision taken thereon to the petitioner. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ B. S.
