The facts of the case is that the petitioner’s land was acquired by the respondents for National Highway. The petitioner is aggrieved by the quantum of compensation awarded by the respondents. 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No. 20884 of 2026 Now, the petitioner is seeking a relief as per Section 64 of the RFCTLARR Act, 2013. 3. The learned Counsel for State of TN for the respondents 1 and 2 submits that as against the order passed by the second respondent, the petitioner is having remedy before the first respondent/District Collector for enhancement of compensation. Hence, if the petitioner submits a representation before the first respondent for enhancement compensation, the same will be considered by the first respondent and appropriate orders will be passed. 4. The learned Counsel for State of TN further submits that in the causetitle, the third respondent is wrongly mentioned. The correct authority is the Project Director, National Highways Authority of India (NHAI), Project Implementation Unit, Ramanthapuram and the same is corrected. Hence, the third respondent is suo motu amended as prayed for. In view of the submissions made by the learned Counsel for State of TN, this Court directs the petitioner to submit a representation for the enhancement of compensation before the first respondent. The first respondent/District Collector shall consider the same and pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. 6. In case the first respondent enhancing the compensation payable to the petitioner, the same may be granted. Otherwise, the matter may be referred to the LARR Authority under Section 64 of the RFCTLARR Act, 2013. 7. This Writ Petition is disposed of, with the above directions. No costs.
