Mr. Pulak Agarwal, learned counsel for the appellant. Ms. Suraiya Naaz, learned counsel holding brief of Mr. Lalit Sharma, learned counsel for the respondent no.5. Ms. Shruti Joshi, learned counsel for the mediator. The case is taken up today before the National Lok Adalat. This Appeal from Order, is arising out of an award dated 22.09.2018, as it was passed by the Motor Accident Claims Tribunal, 1st A.D.J. Nainital in MACP No.165 of 2013. Before the Lok Adalat, learned counsel for the appellant submits that he does not wish to pursue the case further and that the withdrawal sheet records as follows: “The appellant/Insurance Company does not want to further pursue the matter and intends to withdraw the present appeal, reserving the right to contest any enhancement appeal, if any.” The terms of the withdrawal have been recorded in a separate sheet which shall form part of the order. The statutory amount, if any, shall be remitted to the concerned Tribunal and shall be adjusted against the settled amount for the payment to the appellants. In view of the above submission, the appeal stands dismissed as withdrawn. Let the LCR be remitted to the concerned Court/Tribunal. (Siddhartha Sah, J.) 09.05.2026 BS
