ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2) of BNS Act, 2023 r/w 21(1) of Mines and Minerals Act, 1957, in Crime No. 203 of 2026, on the file of the respondent Police, seeks anticipatory bail. 2. The allegation against the petitioner is that he illegally quarried three units of gravel sand in pond and transported the same in a tipper lorry bearing Registration No.TN 63 AV 7093. Hence, the case has been registered. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the investigation in this case is still pending and no previous case has been registered against him. However, he oppose to grant anticipatory bail to the petitioner. 5. Considering the above facts and circumstances of the case, the petitioner has illegally quarried sand from pond which is the lifeline of various villages and since they also caused damage to the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner. 6.
