The petitioner is apprehending his arrest in connection with Barhait P.S. Case No. 120 of 2025, registered for the offence under Sections 303(2), 317(2), 317(5) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the Court of learned S.D.J.M., Sahibganj. 3. Learned counsel appearing for the petitioner submits that the petitioner happens to be the owner of the truck and the said truck was hired by one Kashmira Enterprises, Ranchi for carrying the pipes in the State of Chhattisgarh. He submits that the allegations are made that the said pipes have been recovered from the truck and only because the petitioner is the owner, he has been implicated in the case. He also submits that the petitioner has got no criminal antecedent as disclosed in para 16 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that pipes have been recovered. 5. Considering that the petitioner is the owner of the said truck and the said truck was hired by one Kashmira Enterprises, Ranchi for carrying the pipes to the State of Chhattisgarh and the petitioner has got no criminal antecedents as disclosed in para 16 of the petition and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
