The present Writ Petition has been filed to quash the impugned online refusal passed by the respondent in application No. 2025/0105/24/752110 dated 23.09.2025 and also to direct the respondent to conduct fresh enquiry after affording an opportunity and pass a reasoned order. 3. The facts of the case is that the the petitioner has claimed right over the property situated at Survey No.446/3C, Thiruparankundram Village, Thiruparankundram Taluk, Madurai, based on the registered Sale Deed in Doc.No.1/4791/2025. The petitioner has purchased an extent of 1983.5 sq.ft, of the land in the said survey number. Based on the same, the petitioner has submitted an application in No. 2025/0105/24/752110 dated 23.09.2025 before the respondent. However, the same was refused by the respondent without assigning any reason. Hence, the petitioner is 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No. 20914 of 2026 before this Court. 4. The contention of the petitioner is that the impugned order is a non-speaking order, wherein it is stated FIFO (First in First out). FIFO means that based on the seniority, the application will be considered and that apart, there is no reason for rejection of the application filed by the petitioner. 5. Heard the learned counsel for the petitioner and the learned Counsel for State of TN for the respondent. 6. Since the petitioner sought patta on the strength of the Sale Deed, the respondent cannot reject the application without assigning any reason and thereby, the impugned order is a non-speaking order. Hence, the impugned order is quashed and the matter is remitted back to the respondent to pass a fresh order on merits and in accordance with law after affording an opportunity to the petitioner. 7. The respondent shall consider the application filed by the 3/5 https://www.mhc.tn.gov.in/judis W.P(MD)No. 20914 of 2026 petitioner for issuance of patta and pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. 8.
