This Court has dismissed the said writ petition at the admission stage on the premise that the father of the petitioner, during his lifetime, never made any claim for payment of any terminal benefits, though he was alive for 24 years, after he was discharged from service and therefore, the petitioner herein cannot make any such claim after the demise of his father. 3. Review of the said order is sought on the ground that the father of the petitioner during his lifetime made a claim for payment of retirement benefits by submitting a representation before the Chief Minister Cell and the same was responded to by the Director, Adi Dravidar Welfare Department, Chennai, through proceedings in RC.No.B2/19490/2005, dated 06.06.2005. A copy of the said proceeding is also placed before this Court. 4. From the perusal of the said document, prima facie it appears 2/6 https://www.mhc.tn.gov.in/judis that the deceased father of the petitioner, during his lifetime, made a claim for payment of terminal benefits from the respondents. Had the said proceedings dated 06.06.2005 had been placed before this Court when the matter was disposed of on 01.06.2026, this Court would not have dismissed the writ petition at the admission stage and instead would have called for a counter from the respondents. 5. In the circumstances, this Court, is of the considered view that the petitioner has made out a ground for review of the order dated 01.06.2026 and accordingly, the said order dated 01.06.2026 is hereby recalled and WP.(MD)No.14016 of 2026 is restored under the file of this Court. 6. Registry is directed to list the main writ petition for further consideration on 31.07.2026.
