For Petitioner(s): Mr. T.Meganathan For Respondent(s): ORDER This Civil Revision Petition (CRP) has been filed challenging the impugned order passed by the III Additional District and Sessions Court, Virudhachalam, in I.A.No.2 of 2025 in O.S.,No.202 of 2023, dated 12.06.2025. 2. In the aforesaid order, the application filed by the petitioner, who is the defendant in the suit, under Order VIII Rule 9 of the Code of Civil Procedure https://www.mhc.tn.gov.in/judis CRP No. 4357 of 2026 __________ Page2 of 4 seeking leave of the trial Court to file an additional written statement, has been dismissed on the ground that the application has been filed at a belated stage. 3. The learned counsel for the petitioner would submit that there became a necessity for the petitioner to file an additional written statement, since, in the earlier written statement, the petitioner/defendant failed to take the defence by stating that the petitioner/defendant had paid the dues of the respondent/plaintiff during the COVID-19 period. 4. Admittedly, the application was filed by the petitioner/defendant when the suit was posted for defendant’s side evidence. At that stage, had the trial Court entertained the application, the trial Court would have had to frame additional issues, and examine the plaintiff as a witness, resulting in further delay in the disposal of the suit. The suit has been filed by the respondent/plaintiff for recovery of money. The trial Court has rightly dismissed the petitioner’s application on the ground that it has been filed belatedly, when the suit was posted for defendant’s side evidence. 5. This Court does not find any infirmity in the reasons given by the trial Court for dismissing the petitioner’s application, as no sufficient cause has been show by the petitioner for the delay in filing the application under Order VIII Rule 9 CPC seeking leave of the trial court to file an additional written https://www.mhc.tn.gov.in/judis CRP No. 4357 of 2026 __________ Page3 of 4 statement. Accordingly, this Civil Revision Petition is dismissed as devoid of any merit. No Costs.
