Mr. Raunak Pant (through video conferencing), Advocate, holding brief of Mr. Naresh Pant, Advocate for respondent no. 3. 4. According to the petitioners, their land was acquired for construction of National Highway, however, the officers of National Highway Authority of India have issued a notice alleging that petitioners have encroached upon land belonging to the Authority. 5. Learned counsel for petitioners submits that identical issue was dealt with by this Court in WPMS No. 1434 of 2026. He submits that this writ petition may be decided in terms of that judgment. 6. Learned counsels appearing for the respondents submit that they have no objection if the writ petition is decided in terms of that judgment. 7. Accordingly, the writ petition is decided in terms of the judgment dated 20.05.2026 rendered in WPMS No. 1434 of 2026. Petitioners are permitted to submit their reply to the notice within a week before the competent authority. If 2026:UHC:3986 petitioners submit reply within one week, then no coercive action shall be taken against him till final order is passed by the competent authority, after considering the reply submitted by the petitioners. The competent authority is directed to take decision in the matter, after considering the reply of petitioners, as per law, within one month. For a period of five weeks or till decision is taken by the competent authority, whichever is earlier, status quo as regards the structures raised by petitioners shall be maintained.
