In seven suits, the plaintiff in the suit O.S.No.3 of 2023 now sought to be transferred is the attestor and all the promissory notes are dated 13.03.2020. The petitioner has taken other defence disputing his liability and also fabrication etc. of the documents by referring to some other legal proceedings etc. 4. This Court, under a common Order dated 01.07.2024 in Tr.C.M.P.Nos.239, 244, 245, 247, 256, 264 and 293 of 2023, passed orders transferring seven cases against the petitioner herein from various Courts at Parvatipuram, Vijayawada, Yelamanchili, Narsipatnam, Tuni and Bobbili, considering the commonality of the date of the promissory notes, the scribe and other incidental factors, by discussing the rival contentions. The promissory note in the present case is also dated 13.03.2020. 5. Upon considering the orders passed by this Court in the Transfer Civil Miscellaneous Petitions referred to supra and upon considering the nature of the defence with reference to the written statement, this Court finds the prayer for withdrawal and transfer of O.S.No.3 of 2023 from the file of learned Senior Civil Judge, Yelamanchili to the file of the learned VII Additional District Judge, 6 Vijayawada, to which Court all the other eight cases have been transferred found convincing. 6. Accordingly, the Transfer Civil Miscellaneous Petition is allowed as follows: (i) The learned Senior Civil Judge, Yelamanchili is requested to transmit the record in O.S.No.3 of 2023, duly indexed, forthwith. (ii). The learned VII Additional District Judge, Vijayawada is requested to dispose of the case according to law by giving fair opportunity to both parties. (iii). The learned VII Additional District Judge, Vijayawada may explore the possibility of settlement before proceeding with the trial. (iv). There shall be no order as to costs. 7. Consequently, miscellaneous petitions, if any, shall stand closed. The Interim Order granted, if any, shall stand vacated. ____________________________ A.
