The learned counsel appearing for the applicant would submit that the suit in which the defendant had been set ex-parte, the present Application had been filed to mark the partnership Deed of the plaintiff as the secondary evidence to substantiate its existence from the year 2009. The suit is primarily for trade mark which has also been substantiated by a legal heir certificate issued in favour of the applicant. 4. In such view of the matter, I do not find any impediment in ordering the application as prayed for.
