The second ground is that there is no enforceable liability as far as the petitioner/accused is concerned. Both the allegations are factual in nature have to be established by cross examining the complainant witness and cannot be treated as an incontrovertible fact by this Court so as to entertain the quash application. 3.Therefore, keeping open the liberty of the petitioner to raise all these grounds during the course of the trial. The criminal original petition stands disposed of. At this juncture, the learned counsel for the petitioner pleads hardship for the petitioner to appear before the trial Court. In view of the same, the presence of the petitioner before the trial Court shall stand dispensed with except for such hearings as may be insisted upon by the trial Court.
