1. This bail application has been filed under Sections 483 and 484 of the Bhartiya Nagarik Suraksha Sanhita, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody in connection with N.D.P.S. Case No. 09 of 2025 arising out of Bagodar P.S. Case No. 158 of 2023 for allegedly committing offence punishable under Section 20(b)(ii)(c) of the N.D.P.S. which is pending in the Court Learned Sessions Judge, Giridih.
2. Heard, learned counsel for the petitioner, learned counsel for the State.
3. Earlier the bail application of the petitioner was earlier rejected by the co-ordinate Bench of this Court on merits.
4. Learned A.P.P. opposes the prayer for bail and submits that only three witnesses remain to be examined in this case.
5. Considering the fact of recovery and progress of trial, I am not inclined to release this petitioner on bail. Accordingly, this bail application is dismissed with a liberty to renew his bail application after four months.
