Heard learned counsel Shri Ananta Ramteke for the petitioner – student; learned Assistant Government Pleader for respondent No.1 - The Deputy Director and Member Secretary, Scheduled Tribe Certificate Scrutiny Committee, Nagpur (the Committee), and learned counsel Shri Nikhil Gaikwad for respondent No.2 – State Common Inference Test Cell, Maharashtra State, Mumbai.
2. Contention is that, the petitioner – student has submitted her caste claim to the Committee for verification towards “Mana Scheduled Tribe” on 19.9.2025. An acknowledge to that effect is on record at page No.13 (Annexure-B). 2026:BHC-NAG:11561-DB

Learned counsel for the petitioner - student submits that the caste claim of the petitioner – student is still pending with the Committee. Interregnum, the petitioner – student was provisionally admitted to respondent No.3 - College on the basis of allotment made by respondent No.2. Receipt_cum_acknowledgment of admission to the First year Under Graduate Technical Courses in Engineering and Technology (4 Years) and Master of Engineering and Technology (Integrated 5 Years) Admissions Assessment Year 2026-2027 is at page No.18 (Annexure-F).
He submits that in view of note at the bottom of the aforesaid receipt_cum_acknowledgment, the petitioner – student is required to submit her Caste Validity Certificate during the registration process, failure to do so, would result in automatic cancellation of her admission. In view of the aforesaid background, the petitioner – student has approached this court.
4. Learned Assistant Government Pleader for the Committee, upon instructions, submits that the caste claim of the petitioner - student shall be decided within a period of three months from today.
5. In view of the above, we dispose of the present writ petition, as per order below:
ORDER (1) The Writ Petition is disposed of.
3 17 wp6819.26.odt (2) The respondent No.1 - The Deputy Director and Member Secretary, Scheduled Tribe Certificate Scrutiny Committee, Nagpur is directed to decide the caste claim of the petitioner - student towards “Mana Scheduled Tribe” within a period of three months from today. (3) The respondent Nos.2 and 3 are directed not to insist upon the petitioner – student to submit her Caste Validity Certificate, till decision of the validation proceeding by the Committee. (4) The petitioner – student shall cooperate with the Committee in adjudication of her caste claim expeditiously without seeking unnecessary adjournments. (5) Needless to mention that the aforesaid admission of the petitioner – student under the Reserved Category in the respondent No.3 - College would be subject to final outcome of the caste claim decided by the Committee. (6) With this, the writ petition is disposed of. No costs.
