(2) Petitioner is aggrieved by recovery citation dated 25.4.2026, issued by Tehsildar, Bageshwar. Recovery citation is on record as Annexure-1 to the writ petition, whereby a sum of ₹5,91,369 + recovery charges are sought to be recovered from the petitioner. (3) Learned Counsel for the petitioner submits that KCC loan of ₹3,00,000 was sanctioned to the petitioner by State Bank of India, out of which he availed loan only to the extent of ₹2,00,000. It is contended that petitioner has already paid a sum of ₹1,15,000 towards loan account and further that because of medical condition, he could not repay the loan in time. Learned Counsel further subm its that petitioner be perm itted to repay the loan in easy instalments, as he is very much willing to repay the loan. (4) Mr. Krishnakant Joshi, learned Counsel appearing on behalf of bank, on instructions, submits that bank has no objection if petitioner is given some reasonable tim e for repaying the loan. He further subm its that this Court can fix instalments for that purpose. (5) In view of consensus between the 2026:UHC:3818 parties, writ petition is disposed of with the following directions: “(i) Petitioner shall deposit a sum of ₹1,00,000 with the bank positively within six weeks. (ii) Subject to deposit of the aforesaid amount within stipulated time, petitioner shall be perm itted to repay the balance amount in ten equal monthly instalments. (iii) Last instalment shall carry the component of interest. (6) In case of any default on the part of petitioner in abiding the aforesaid conditions, bank shall be at liberty to proceed against him, as per law.
