The petitioners are apprehending their arrest in connection with Complaint Case No.1603 of 2019, registered for the offence under Sections 33, 41 and 42 of Indian Forest Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Chatra. 3. Learned counsel appearing for the petitioners submits that the petitioners are neither owner nor driver of the tractor. He further submits that the allegations are there of carrying Morem on the tractor and due to movement of the tractor and further allegations are made of destroying the plants. 4. Learned counsel appearing for the State opposed the prayer and submits that the plants have been destroyed by the said tractor. 5. Considering that the petitioners are neither the owner nor driver of the tractor and the allegations are made of carrying Morem on the said tractor and destroying the plants by the said tractor and in that view of the matter, the petitioners are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions as the learned Court may deem fit and proper. 6.
