CLCON No.244 of 2026 Hon ’ble Rak esh Th apliyal, J.
Mr. S.K. Mandal, learned counsel for the petitioner.
2. The counsel for the petitioner himself admits that pursuant to the judgment passed by the Division Bench dated 06.03.2025 in Special Appeal No.346 of 2017, the petitioner has already been reinstated. So far as the remaining part is concerned with regard to continuity in service and the salary, since the petitioner has already been reinstated, he will certainly get the salary from the date of reinstatement. So far as the continuity of service is concerned, it should be presumed to be continuous and shall be subject to the disciplinary enquiry, for which the writ court has already directed that the judgment will not preclude the respondents from initiating such an enquiry.
3. I do not find any substance in this contempt petition, the same is dismissed.
