The petitioners are apprehending their arrest in connection with Jaridih P.S. Case No.105 of 2025 for the alleged offences registered under Sections 303(2), 317(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Section 21 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004 and under Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned A.C.J.M., Bermo at Tenughat. 2026:JHHC:10022 --2-- A.B.A. No. 1419 of 2026 3. Learned counsel appearing for the petitioners submits that the petitioners are owners of two different trucks and the allegations are made of loading 25 tons of coal on each of the trucks. He further submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.12 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioners happened to be owners of two different trucks. 5. Considering that the petitioners are owners of two different trucks and the petitioners have got no criminal antecedent as disclosed in paragraph No.12 of the petition and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
