The petitioner has filed this writ petition seeking following reliefs:- “10.1 That the Hon'ble Court may kindly be pleased to allow this writ petition and may kindly grant the 2 petitioner the benefit of leave encashment of 404 days and the two consequential promotionary benefit which the petitioner is entitled from the year 31.10.1995, in the interest of justice. 10.2 That the Hon'ble Court may kindly be pleased to direct the respondent authority to consider the case of the petitioner as per the service book and take decision on the representation dated 21.05.2024, 08.01.2026 which is pending, in the interest of justice. 10.3 Any other relief, which this Hon'ble Court may deem fit and proper according to the facts and circumstances of the case along with the cost of the petition.” 2. Learned counsel for the petitioner submits that the husband of petitioner while working on the post of Head Master, Government Primary School stood retired from service on 30.10.1995. However, the husband of the petitioner was not paid the leave encashment and the benefit of the time scale pay for which, petitioner submitted a representation on 08.01.2026 which is pending consideration till date and therefore, direction be issued to the Respondent No. 4 to consider and take decision on the representation at the earliest within specified time frame. 3. On the other hand, learned counsel for the respective respondents would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 4 to consider and take decision on the representation, they are having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of directing the Respondent No. 4 to consider and take decision on the representations dated 21.05.2024, 3 25.12.2025 and 08.01.2026 submitted by the petitioner in accordance with law, expeditiously, preferably within a period of 03 months from the date of receipt of representation. 6.
