1. The present writ petition has been filed, inter alia, complaining illegal construction at 1/H/3, R.A.N. Singha Lane, P.O and P.S. Beliaghata, Kolkata
700010.
2. Mr. Banerjee, learned advocate for the KMC by filing a report through the Executive Engineer(c) building department would submit that although an inspection had been carried out and a local enquiry conducted, the same reveals that premises No. 1/H/3, R.A.N. Singha Lane, P.O and P.S. Beliaghata, Kolkata 700010 is vacant land and no construction is found at the site.
3. Having regard to the above and though the petitioner seeks to withdraw the writ petition, noting that a false complaint has been made and the state machinery has been activated on the basis thereof, I am of the view the writ petition should be

dismissed with the cost of Rs. 1,000,00/- to be paid by the petitioner to the municipality.
4. With the above observations and directions, the writ petition is dismissed.
