(2) Petitioner has challenged the select list dated 17.1.2026, published by Uttarakhand Medical Service Selection Board for the post of Pharmacist (Allopath). According to petitioner, names of certain persons, who are already serving as Pharmacist in other departments under the State, also figure in the impugned select list, which is contrary to the condition mentioned in the advertisement issued by the selecting body. He refers to Clause 7 of the advertisement, according to which every candidate has to furnish an affidavit that he/she is not already employed in other department. By means of this writ petition, petitioner has sought the following relief:
“(i) Issue a writ, order or direction in the nature of Certiorari calling for records and quashing the impugned final merit list/selection list dated 17.1.2026 (annexed as Annexure No.4 to this writ petition) so far as it relates to the selection of Virendra Kumar, Serial no. 45, Roll No. 9250601141 i.e. the respondent no.6 and Khushi Ram, Serial no. 46, Roll No. 9250601145 i.e. the respondent no.7 under SC category.
(ii) Issue a writ, order or direction in the nature of the Mandamus to delete the name of
2026:UHC:891 the candidates Virendra Kumar, Serial no. 45, Roll No. 9250601141 i.e. the respondent no.6 and Khushi Ram, Serial no. 46, Roll No. 9250601145 i.e. the respondent no.7 under SC category selected in the Impugned Final Merit list/Selection list dated 17.1.2026 (annexed as Annexure No.4 to this writ petition) and consider the name of the petitioner for the post of Pharmacist under SC category pursuant to the advertisement dated 19.10.2024 (annexed as Annexure No.1 to this writ petition).
(iii) Issue a writ, order or direction in the nature of the Mandamus to consider and decide the representation dated 29.1.2026 (annexed as Annexure No. 7 to the writ petition) of the petitioner and consider the candidature of the petitioner on the post of the Pharmacist under SC category pursuant to the advertisement dated 19.10.2024 (annexed as Annexure No. 1 to this writ petition).”

Learned Counsel appearing for the selecting body, however, submits that persons named by the petitioner, as have been employed in other departments, were actually offered appointment in Veterinary Department, however those persons have given affidavit to the selecting body that they are not serving in any other department.
(4) Without going into other issues raised by the petitioner, writ petition is
disposed of with liberty to petitioner to make representation to the Director General, Medical and Health Department. If he makes representation within ten days from today, decision thereupon shall be taken, as per law, within four weeks thereafter.
