3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in judicial custody since 02.12.2024 and is ready to abide by any conditions that may be imposed by this Court. It is submitted that there are six accused in the case and A4 and A6 have already been enlarged on bail. Hence, he prayed for the grant of bail.
4. The learned Government Advocate (Crl.Side) opposed the bail application and submitted that though A4 and A6 have been enlarged on bail, there was no recovery from them. The entire recovery of 21 kilograms of ganja, which is a commercial quantity, was effected only from the present petitioner. Hence, the rigour under Section 37 of the NDPS Act squarely applies.
5. I have given anxious consideration to the submissions made by the
learned counsel on either side.
6. Considering the submission of the learned counsel on either side, it is seen that there was no recovery from A4 and A6. However, according to the prosecution, the entire recovery of 21 kilograms of ganja, which is a commercial quantity, was effected only from the present petitioner. Except the long period of incarceration from 02.12.2024, no other ground has been made https://www.mhc.tn.gov.in/judis
