(Oral) This writ petition has been filed by petitioner seeking a writ of mandamus commanding respondent Nos.1 to 8 to conduct a joint spot inspection through the Revenue, Irrigation and Development Authorities, within a fixed time prescribed by this Court in respect of the public gul/nala/drainage channel, situated at Village Bari Anjaniya, Tehsil Khatima, District Udham Singh Nagar. 2. It was contended by learned counsel for petitioner when the case was called as fresh that private respondents are encroaching over aforesaid public gul. 3. This Court called instruction from the learned State Counsel. 4. Today, learned State Counsel produced instruction before this Court, which is taken on record. 2026:UHC:3564 2 5. Learned State Counsel, on the basis of instruction, made a statement before this Court that in addition to respondent Nos.9 to 11, six other person are also found encroaching upon the aforesaid public gul/nala/drainage channel and they have been called upon by issuing notices to remove the encroachment within a period of 15 days on their own, otherwise, State authorities shall take strict action for removal of the encroachment so made by the encroachers. 6. Since, respondents-authorities have taken cognizance of the matter and issued notices to encroachers, this Court feels that the purpose of filing the present writ petition has now been fulfilled. 7.
