Mr. Arnab Nandi Mr. Daniel Sarkar Mr. Sohel Tudu …for the Petitioner This is an application wherein the petitioner has prayed for a direction upon the court below for expeditious disposal of the criminal proceedings being G.R. case no. 3413 of 2010, presently pending before the learned Judicial Magistrate, 1st Court, Sealdah. Learned counsel for the petitioner submits that the FIR was lodged in the year 2010 and the investigation culminated into a charge-sheet in the year 2012. Thereafter, the charge was framed in the year 2013 and the court started recording evidence of the prosecution witnesses on 6.12.2013. however, the evidence of PW 1 has not been completed till date and the Trial court only fixed five dates during the said period for examination of the witnesses, which is quite unusual. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with. 2 Having heard learned counsel for the petitioner and also considering the long pendency of the instant proceeding, I find that the prayer made by the petitioner is justified and required to be allowed for the ends of justice. In view of above, CRR 165 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour to expedite the trial and to make his best effort to conduct day to day trial, if possible and will conclude the trial preferably within a period of six months from the next date of hearing without granting any unnecessary adjournment to either of the parties. This order is passed invoking this court’s jurisdiction under Section 529 of the BNSS.
