ORDER The prayer in this Criminal Original Petition is to transfer the investigation in Crime No.0141 of 2026 from the file of the third respondent Police to the file of CBCID, Villupuram in the interest of justice. 2. On the earlier occasion, it was represented on behalf of the respondent Police that the investigation is completed and a Final Report is filed before the jurisdictional Magistrate dropping all further action concluding that it was a case of suicide. For which, the learned Counsel for the petitioner expressed a serious apprehension and therefore, the matter was posted today for further arguments and also for production of the postmortem report. 3. The learned Counsel for the petitioner would submit that the person who died is a well built man and he is said to have been hanging for about six hours that too with a sari of the concubine. The same by itself is unbelievable. Secondly, it must be seen that he was last seen along with one Sakthivel. The said factor is not at all examined. Since it was found that 500 ml of alcohol was present in the body of the deceased, which is evident from the postmortem, the person having alcohol with him was also not thoroughly examined. Therefore, inspite of filing the Final Report, this Court should order fresh investigation into the entire episode. 4. I have considered the said submissions made by the learned Counsel for the petitioner. 5. From the postmortem report, it is seen that the husband of the petitioner, who is deceased, was also having a tattoo mark depicting the alleged concubine's name. The other features are also considered in the postmortem report. His weight of 80 kilograms was also considered. It can be seen that though the hyoid bone and thyroid cartilage were intact, the final opinion of the postmortem is that the deceased appeared to have died of asphyxia due to hanging. Therefore, this is not a case where, on the face of it, there is any ground for this Court to order further or fresh investigation. Now, it is stated that the Final Report is filed.
If the petitioner is still aggrieved, the petitioner can file such protest petition before the Trial Court bringing forth any material, if the petitioner still 3/5 https://www.mhc.tn.gov.in/judis
Crl.O.P.No.18091 of 2026 feels suspicion or that there is any ground to alter the First Information Report and to investigate, it is for the Trial Court to consider the same on its own merits in accordance with law. 6.
