4. Petitioner is an ex-serviceman, who retired from the post of Colonel from Indian Army. He was appointed as Deputy General Manager on contract in Uttarakhand Purva Sainik Kalyan Nigam Ltd. vide order dated 30.08.2019 for a term of three years. The term of three years, for which petitioner was appointed was to come to an end on 29.08.2022, however, his term was extended upto 31.08.2023, vide order dated
23.08.2022. Petitioner’s engagement was not extended any further beyond 31.08.2023.
5. Petitioner filed this writ petition contending that his engagement deserves to be extended till he attains age of 65 years in view of provision made in the Government
Order dated
02.05.2016.

learned counsel appearing for respondent no. 2 submits that the Board of Uttarakhand Purva Sainik Kalyan Nigam
2026:UHC:3773-DB Ltd. has recommended case of the petitioner for extension to the State Government. He submits that period for which extension was sought has now come to an end and no further recommendation could be made because of pendency of this writ petition.

Learned counsel for the petitioner submits that petitioner be permitted to make application directly to the State Government for extending his term and the State Government be directed to take decision on the application, in the light of recommendation made by the Board of UPNL,` in its meeting dated 28.02.2023.
8. It is nobody’s case that the work and performance of the petitioner was found to be wanting and the recommendation made by Board of UPNL indicates that the superior authorities of UPNL were satisfied with petitioner’s work and conduct.
9. We, therefore, permit the petitioner to make application seeking extension/ reappointment. Such application, if made, within two weeks from today, shall be decided by the Secretary, Sainik Kalyan Vibhag, within four weeks thereafter.
10. The writ petition stands disposed of in aforesaid terms.
