The case of the petitioner is that he submitted online applications dated 15.05.2026 and 02.07.2026 to the respondent, seeking to measure and fix the boundaries of lands comprised in S.Nos. 392/1, 392/2, 392/3, 392/4A, and 392/4B, measuring a total extent of 12.70 Acres (5.14.17 hectares) situated at Morattupalayam Village, Perundurai Taluk, Erode District. However, the said applications have not been disposed of to date. Aggrieved by this inaction on the part of the respondent, the petitioner has filed the present Writ Petition __________ Page2 of 5 https://www.mhc.tn.gov.in/judis WP No. 28333 of 2026 3. Ms.Inthu Karunakaran, learned Government Counsel appearing for the respondent, submitted that the applications of the petitioner dated 15.05.2026 and 02.07.2026 would be considered and appropriate orders would be passed thereon, on merits within a period of six weeks. 4. In view of the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Court directs the respondent to consider the petitioner's online applications dated 15.05.2026 and 02.07.2026 on merits and in accordance with law. The respondent shall conduct a survey of the subject property comprised in S.No.392/1, 392/2, 392/3, 392/4A and 392/4B in all totally measuring an extent of 12.70 Acres (5.14.17 hec) situated at Morattupalayam Village, Perundurai Taluk, Erode District. and fix the boundary stones within a period of six (6) weeks from the date of receipt of a copy of this order, after issuing prior notice to the petitioner, adjacent land owners and interested parties, if any. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in __________ Page3 of 5 https://www.mhc.tn.gov.in/judis WP No. 28333 of 2026 taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 5. With the above directions, this Writ Petition stands disposed of.
