Ms. Indu Sharma, learned counsel for the appellant. Mr. M. K. Goyal, learned counsel for the Insurance Company. Mr. Sourabh, Deputy Manager of New India Assurance Company Ltd. Mr. Mahesh Chandra Pant, learned counsel for the mediator. The case is taken up today before the National Lok Adalat. Ms. Vishweshwari Devi, appellant, is present through V.C. duly identified by Ms. Indu Sharma, Advocate. This Appeal from Order, is arising out of an award dated 31.01.2017, passed by the Motor Accident Claims Tribunal/District Judge, Almora in MACP Case No.19 of 2016. Before the Lok Adalat, the parties have agreed to settle the matter and have arrived at a compromise. The terms of the compromise are as follows: “The Insurance Co. has entered into compromise/settlement with the claimant/Appellant. The Insurance Co. is ready to pay Rs. 16,00,000/- (Rs. Sixteen Lacs) as full & final over and above the awarded amount to the Appellants/claimants. This amount will not carry any interest and the amount will be paid to the claimants/Appellants within 8 weeks (eight weeks) from the date of obtaining certified copy of the order” The terms of the compromise have been recorded in a separate compromise sheet which shall form part of the order. The statutory amount, if any, shall be remitted back to the concerned Tribunal and shall be adjusted against the settled amount for the payment to the appellants.
