ORDER This Civil Revision Petition has been filed under Article 227 of Constitution of India to direct the Principal District Court, Vellore to number the suit in O.S..Sr.No.3213 of 2024 on the file of the Principal District Court, Vellore.
2. According to the petitioner/Plaintiff, the plaint was presented before the Principal District Court, Vellore in O.S.Sr.No.3213 of 2024, pursuant to the
Judgment passed by this Court on 20.04.2023 in S.A.No.1205 of 2010. In the said Second Appeal, the appellant therein who is the petitioner herein was
directed to present the returned plaint before the jurisdictional Court on or before 31.08.2023. Learned counsel for the petitioner would submit that the plaint was returned to him by the Registry of the High Court only after the deadline fixed under the Judgment dated 20.04.2023 passed in S.A.No.1205 of
2010. In view of the same, the plaint was represented before the Principal District Court, Vellore which is the jurisdiction Court in O.S.Sr.No.3213 of
2024.
2.1. Further he would submit that despite explaining to the Court below, the reason for the delay in re-presenting the plaint, the Court below has not numbered the suit till date. Learned counsel for the petitioner also drew the https://www.mhc.tn.gov.in/judis
CRP No. 4248 of 2026 __________ Page3 of 6 attention of this Court to the various returns passed by the Principal District Court, Vellore in O.S.Sr.No.3213 of 2024.
3. Admittedly the petitioner’s counsel was not granted an opportunity to put forward his submissions before the Court to establish that the suit in O.S.Sr.No.3213 of 2024 has to be numbered and summons has to be sent to the defendants.
4. This Court has also perused various returns passed by the District Court, Vellore, returning the plaint for certain compliances to be made by the petitioner/plaintiff. But as seen from those returns, the petitioner’s counsel has not been granted an opportunity to make his submissions before the Court to establish that the suit in O.S.Sr.No.3213 of 2024 has to be numbered and summons has to be sent to the defendants.

Since no opportunity of hearing was granted to the petitioner’s counsel by the Principal District Court, Vellore, this Civil Revision Petition is disposed of, by directing the Principal District Court, Vellore to list OS.Sr.No.3213 of 2024 before the Court ‘for maintainability’ on a specified date. On that specified date, the petitioner’s counsel shall address the Court with regard to the maintainability of the suit filed in O.S.Sr.No.3213 of 2024 and try to convince the Principal District Court, Vellore that the suit is maintainable and it has to be https://www.mhc.tn.gov.in/judis
CRP No. 4248 of 2026 __________ Page4 of 6 numbered and summons has to be sent to the defendants. If the Principal District Court, Vellore is convinced based on the submissions made by the
learned counsel for the petitioner, the Principal District Court, Vellore shall number the suit in O.S.Sr.No.3213 of 2024 and issue summons to the defendants and if the Principal District Court, Vellore finds otherwise, the Principal District Court, Vellore, shall pass a speaking order, after giving due
consideration to the submissions made by the learned counsel for the petitioner with regard to the maintainability of the suit. The aforesaid exercise shall be completed by the Principal District Court, Vellore within a period of four weeks from the date when the suit is listed for maintainability. No costs.
6.
