The present Criminal Appeal has been preferred against the judgment of conviction dated 16.07.2018 and order of sentence dated 19.07.2018 passed by the learned Additional Sessions Judge-I-cum-Special Judge (POCSO), Dhanbad in Special POCSO Case No.24 of 2016, whereby the appellant has been convicted for the offence under Section 10 of the Protection of Children from Sexual Offences Act and has been sentenced to undergo rigorous imprisonment for seven years with fine of Rs.25,000/- for the offence under Section 10 of the Protection of Children from Sexual Offences Act. In default of payment of fine, to undergo rigorous imprisonment for four months. 2. It has been submitted by the learned counsel for the appellant that the appellant has already served out the sentence and as such, he does not want to press the present criminal appeal. 3. The custody report has been submitted by the learned counsel for the State. Let it be kept on record. 4.
