For Petitioner(s): Mr. Ma.Gouthaman For Respondent(s): Notice dispensed with ORDER This Civil Revision Petition has been filed under Article 227 of the Constitution of India, seeking to strike off the plaint in O.S. No. 442 of 2025 https://www.mhc.tn.gov.in/judis CRP No. 4266 of 2026 pending on the file of the Principal District Court, Chengalpattu. 2. The petitioners are the defendants 24 to 27 in the suit O.S. No. 442 of 2025. The petitioners claim that the suit in O.S. No. 442 of 2025 is hopelessly barred by the law of limitation. They also claim that there is no cause of action for the plaintiffs to sue the petitioners. Through this Civil Revision Petition filed under Article 227 of the Constitution of India, the petitioners seek to strike off the plaint in O.S. No. 442 of 2025 pending on the file of the Principal District Court, Chengalpattu. 3. The law is now well settled by the recent decision of the Honourable Supreme Court in the case of P. Suresh Vs. D. Kalaivani reported in 2026 SCC Online SC 143 that the High Court, while exercising its power under Article 227 of the Constitution of India, cannot strike off the entire plaint in a suit when there is an alternate remedy available to the petitioners before the trial Court under CPC for rejection of plaint under Order VII Rule 11 of CPC. 4. In view of the aforesaid decision of the Honourable Supreme Court, this Civil Revision Petition filed by the petitioners under Article 227 of the Constitution of India, seeking to strike off the plaint is not maintainable. Hence, this Court is not entertaining this Civil Revision Petition, but however, grants https://www.mhc.tn.gov.in/judis CRP No. 4266 of 2026 liberty for the petitioners to approach the trial Court, namely the Principal District Court, Chengalpattu, for filing an application under Order VII Rule 11 of CPC, seeking for rejection of plaint filed in O.S. No. 442 of 2025. 5. Accordingly, since this Civil Revision Petition is not maintainable under Article 227 of the Constitution of India, this Civil Revision Petition is disposed of by granting liberty to the petitioners to file an application under Order VII Rule 11 of CPC, seeking for rejection of plaint filed in O.S. No. 442 of 2025 before the Principal District Court, Chengalpattu. The said Court shall entertain the application as and when it is filed by the petitioners and dispose of the same as expeditiously as possible. No Costs.
