Mr. Gaurav Panwar, learned counsel holding the brief of Ms. Prabha Naithani, learned counsel for the petitioners. 2. Mr. B.C. Joshi, learned A.G.A. for the State. 3. The petitioners have certain grievance in respect of the land for which the respondent/ complainant executed an agreement to sell in favour of the petitioners. He submits that when the petitioner got information under Right to Information Act, the land was already sold out to third person then he made complaint to the District Magistrate but no action has been taken thereof. 4. The allegation, as alleged, in the complaint can only be looked into if the petitioner lodged any FIR but admittedly he simply made a complaint to the District Magistrate. 5. The State Counsel submits that if the petitioners have any grievance they can approach to the concerned Police Station and if FIR is not registered then the petitioners have a remedy to file application under Section 175 (3) of BNSS 2023. 6. After hearing the arguments of the learned counsel for the parties, this court is of the view that the petitioners have a remedy to either lodge FIR or to move an application under Section 175(3) of BNSS 2023 which they have not availed. 7. In such view of the matter the instant writ petition is dismissed with liberty to the petitioner to avail appropriate remedy as per law. (Rakesh Thapliyal, J.) 18.05.2026 Parul
