Kaaviya For Respondent(s): Mr.T.Muruganantham ORDER This Criminal Miscellaneous Petition has been filed to condone the delay of 252 days in filing the Criminal Appeal in Crl.Appeal Sr.No.36850 of 2024 against the order made in S.T.C.No.327 of 2017 on the file of Learned Judicial Magistrate, Tiruvarur. 2. Heard the learned counsel for the petitioner. 3. The learned counsel for the respondent strongly objected to the condonation of delay petition, submitting that the petitioner has no legal right 1 https://www.mhc.tn.gov.in/judis CRL MP No. 9128 of 2026 and that the cheque was not issued for the discharge of any liability, which has been considered during a full-fledged trial. He further submitted that the present appeal, along with this delay petition, has been filed merely to victimise and harass the respondent. He also contended that no sufficient cause or proper reason has been assigned to explain the delay. 4. Considering the submission made by the learned counsel on either side and having perused the affidavit filed in support of this petition, it is seen that the reason given for the delay is acceptable. In the interest of justice, this Court is of the view that the appeal should be decided on its merits. The objections raised by the respondent can be considered at the stage of admission of the appeal. Accordingly, this Civil Miscellaneous Petition is ordered. 5.
