Judgment dated 20.08.2019 passed in WP No.18061 of 2019 on the file of this Court. For Appellant : Mr.B.Ganesha Moorthy For Respondents : Mr.K.Kumaran Govt. Pleader, for RR 2 to 4.
JUDGMENT (Judgment of the Court was delivered by the Hon'ble Chief Justice) This writ appeal assails the judgment dated 20.08.2019 passed by the learned Single Judge in WP No.18061 of 2019.
2. The first respondent herein had filed the writ petition seeking a direction to transfer the service connection bearing No.172 from Survey No.248 to Survey No.16/2 in Patta No.451 in Kalambur Village, Polur Taluk, Tiruvannamalai District and to change the name of Mr.P.Loganathan, the appellant herein, to P.Duraisamy, the first respondent/writ petitioner, without insisting on the No Objection from the appellant herein within a stipulated time.
3. The learned Single Judge disposed of the writ petition with a direction to consider the representation of the first respondent/writ https://www.mhc.tn.gov.in/judis
WA No.2210 of 2026 petitioner for shifting the electricity service connection.
4. The learned counsel for the appellant submits that the representation has not been decided so far. However, from a perusal of the impugned order, we find that the writ petition was filed by the first respondent herein and the direction is only to decide the representation of the first respondent/writ petitioner. If the representation is not decided, the present appellant should not have any grievance. Moreover, the learned Single Judge has not given any positive finding, but has only directed to decide the representation. Therefore, in such a situation, no cause of action arises for the appellant to file this writ appeal. Finding no merit in this writ appeal, the same is dismissed. There shall be no order as to costs. Consequently, the interim application stands closed.
