W.P.Crl.(MD)No.2249 of 2026 ORDER Seeking to direct the 1st and 2nd respondents to act upon the petitioner's complaint dated 27.03.2026, this writ petition is filed. 2. Considering the limited scope of the relief sought for, notice to the private respondent is dispensed with. 3. The petitioner is married to the 3rd respondent on 28.05.2021 at Arulmigu Meenakshi Amman Temple, Madurai in accordance with Hindu Rites and Customs. At the time of marriage, 9 sovereigns of gold jewellery and home appliances worth about Rs.2 Lakhs and a sum of Rs.50,000/- was given as Sridhana on the insistence of the 3rd respondent's family. However, in due course of time, indifferences erupted due to matrimonial discord and the petitioner was chased away from her matrimonial home. However, the belongings and valuables of the petitioner has been retained by the 3rd respondent. In this regard, the petitioner has also filed HMOP No.131 of 2024 before the Subordinate Court, Melur seeking divorce. The petitioner has also lodged a complaint before the 2nd respondent police seeking recovery of her valuables, for which CSR No.393 of 2024 was issued on 14.08.2024. The learned Government Advocate(crl.side) submitted that the earlier enquiry is already closed based on the undertaking given by the petitioner that she will resolve the dispute before the competent Court of law. If she has any more plight, she is at liberty to approach the police station afresh. 5.
Heard the learned counsel on either side and carefully perused the materials available on record. 6. In response to the submission made by the learned Government Advocate(crl.side), the learned counsel for the petitioner pointed out that already a complaint has been lodged recently on 27.03.2026. The 2nd respondent police is directed to look into the issue forthwith and issue summons to the petitioner and the 3rd respondent under Section 64 BNSS and conclude the investigation as expeditiously as possible within a period of four (4) weeks from the date of receipt of copy of this order and ensure that the petitioner receives all her valuables within the stipulated period of time and in case of the 3rd respondent's failure to return the same, appropriate legal action to be initiated. 7. With the above directions, this Writ Petition stands disposed of.
