Petitioner is a lady who is in custody for more than 9 months. Charge sheet has been submitted. Prosecution has cited 15 witnesses in the charge sheet. Petitioner’s name was earlier enrolled in the voter list. Presently, her roll has been deleted from the Draft Electoral Rolls. Petitioner could not contest the same. However, there are materials to show that the petitioner was intercepted at the BOP.
Be that as it may, as the petitioner is in custody for 9 months and some time will be required to prove the case, as the prosecution has relied upon 15 witnesses and charge sheet has been filed, without entering into the merits of the case, I am inclined to release the petitioner on bail.

Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Sahanara Bibi shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Basirhat. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of sub-division of Basirhat without the prior permission of the Learned Magistrate.
Additionally, petitioner shall make her address available to the Hemnagar Coastal Police Station. Concerned Officer-in- Charge/Inspector-in-Charge may depute any lady officer for surprise check regarding the availability of the petitioner at the address furnished before the Court and the Police Station.
With the aforesaid observations CRM (M) 271 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
