ORDER The petitioner apprehends arrest for the alleged offence under Sections 296(b), 118(1) and 351(3) of Bharatiya Nyaya Sanhita, 2023 read with Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002, in Crime No.80 of 2026, on the file of the respondent police seeks anticipatory bail. https://www.mhc.tn.gov.in/judis
CRL OP No. 19274 of 2026 __________ Page2 of 4 2.The case of the prosecution is that on 08.03.2026 at about 09.30 a.m., when the defacto complainant was at her brother’s house in Gummidipoondi, the accused persons came there, abused and assaulted her. One of the accused allegedly hit her on the chest using a log, causing her to fall unconscious. She was thereafter taken to the Government Hospital, Gummidipoondi. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and has been falsely implicated in this case and has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought anticipatory bail for the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is having five previous cases pending against him. However, he opposed for granting anticipatory bail to the petitioner. 5.I have given my anxious consideration to the submissions made by the

6. From the submissions made by the learned Government Advocate (Crl. Side) for the respondent police, it is seen that the petitioner is a history-sheeter and there are five previous cases pending against him. However, the learned Government Advocate (Crl. Side) further brought to the knowledge of this Court that the investigation is at a preliminary stage. In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail.
