Heard learned counsel for the parties.

The petitioner has retired from the post of Associate Professor in Chandrawati Tiwari Girls Post Graduate College, Kashipur, District Udham Singh Nagar on 08.08.2025.

The case of the petitioner is that the post against which she was appointed was advertised on 08.07.2005 and then on 10.07.2005 in newspaper ‘Amar Ujala’ and on 08-09.07.2005 in newspaper ‘Dainik Jagaran’.

The selection of the petitioner was approved by Kumaon University with which the institution was affiliated on 21.10.2005. The petitioner is claiming that the cut-off date i.e. 01.10.2005 for applicability of the pension scheme would be the date on which the advertisement was issued in view of Government Orders dated 07.11.2023 and 26.06.2025.

The case of the petitioner for extending benefit of old pension scheme to the petitioner has been recommended by the institution to Director Higher Education vide letter dated 20.05.2024, however, the respondents have not taken any decision in the matter so far and, hence, the present writ petition.

Learned State Counsel very fairly states that the representation filed by the petitioner in this behalf shall be considered and decided by the Secretary, Higher Education Department, Uttarakhand, Dehradun (respondent no.1) within such time as may be directed by this Court.

Having regard to the facts of the case and the submissions made, the writ petition is disposed of with direction to respondent no.1 to decide representation of the petitioner dated 07.11.2025 (Annexure No.13) within a period of eight weeks from
