The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 353/2025, registered at Police Station : Dabhara, District- Sakti (C.G.) for the o;ence punishable under Sections 34(2) of the Chhattisgarh Excise Act. 2. The present interlocutory application, being I.A. No. 01/2026, has been ?led on behalf of the applicant seeking permission to withdraw KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 the instant bail application. 3. Learned counsel for the applicant submits that at the time of ?ling the present bail application, the counsel for the applicant could not ascertain that the applicant had already ?led an earlier bail application, which was registered as MCRC No. 9507/2025. It is further submitted that on 24.11.2025, this Court had directed that the said matter be listed after a period of six weeks. Owing to this inadvertent mistake, the brother of the applicant approached the present counsel and ?led another bail application, which came to be registered as MCRC No. 10476/2025 (the present case). It is further submitted that on 06.01.2026, the applicant was already granted the bene?t of regular bail in the earlier bail application, which fact came to the knowledge of the present counsel only on 07.01.2026. Therefore, the applicant seeks permission to withdraw the present bail application. It is submitted that the mistake was bona ?de and deserves to be condoned. 4. Considering the submissions made and taking note of the bona ?de error, the application is allowed. However, a caution is issued to the applicant and his counsel to remain vigilant in the future and to ensure that such lapses are not repeated. 5. Accordingly, I.A.
