CRL OP No. 18008 of 2026 __________ Page1 of 4 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 24-07-2026 CORAM THE HON'BLE MR.JUSTICE C.KUMARAPPAN CRL OP No. 18008 of 2026 Kanhu Charana Bishoi ..Petitioner Vs State represented by its, The Inspector of Police, Sungauvarchatram Police Station, Kancheepuram District, Crime No. 0067 of 2026. ..Respondent PRAYER : Criminal Original Petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the Petitioner/Accused No.1 on bail in Crime No.0067 of 2026 on the file of the respondent police. 3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in judicial custody since 27.03.2026 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for the grant of bail.
4. The learned Government Advocate (Crl.Side) opposed the bail application on the ground that the recovery was effected jointly from both the accused while they were travelling together in a two wheeler. It is submitted that the quantity involved is commercial quantity and mere incarceration cannot be a ground for grant of bail. It is further submitted that the investigation is still pending.
5. I have given anxious consideration to the submissions made by the
learned counsel on either side. 6.According to the prosecution, both the accused were travelling together in the two wheeler and the respondent police recovered 33.170 kilograms of ganja, which is a commercial quantity. The only contention raised by the
learned counsel for the petitioner is the period of incarceration from 27.03.2026. As rightly contended by the learned Government Advocate (Crl.Side), the https://www.mhc.tn.gov.in/judis
CRL OP No. 18008 of 2026 __________ Page3 of 4 investigation is still pending and the quantity involved is commercial quantity. The petitioner has failed to satisfy the twin conditions under Section 37 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. Hence, this Court is not inclined to enlarge the petitioner on bail.
7. Accordingly, this criminal original petition stands dismissed. 24-07-2026 NSL To
