Rawate, learned counsel for the petitioner. 2. The petitioner-Management has approached this Court seeking direction to respondent No.2-Commissioner, Amravati Municipal Corporation to decide its representation dated 12/02/2026 within a stipulated period. 3. Contention is that the petitioner-Management runs a private unaided school without any government aid from standard 1st under the name and style of ‘Harikisan Maloo International School’. The petitioner was issued a notice for payment of property tax by respondent No.2. However, it is submitted that the petitioner is exempted from paying such tax under Section 132 of the Maharashtra Municipal Corporation Act, 1949. The petitioner accordingly submitted a representation dated 12/02/2026 to the respondent No.2 pointing out such exemption so also the judgment of this Court in case of Sant Kanwarram Education and Social Welfare Society and ors. vs. Municipal Corporation of City of Amravati, 2008 (6) ALL MR 384 and the judgment of Hon’ble Supreme Court in case of Municipal Corporation of Delhi vs Children Book Trust, AIR 1992 SC 1456. to substantiate its claim for exemption. 2026:BHC-NAG:7760-DB 2 125-WP-4699-26.odt 4. Shri Sagar Rawate, learned counsel for the petitioner submits that till date, the respondents have not decided the aforesaid representation and are likely to take coercive action against the petitioner. 5. In view of the above, we dispose of the present writ petition with a direction to respondent No.2-Commissioner, Amravati Municipal to decide the aforesaid representation dated 11/02/2026 submitted by the petitioner which is at record page-23, Annexure-F, within a stipulated period of eight weeks from the date of production of the order of this Court. 6. The respondent No.2 shall decide the same on its own merits and in accordance with law and more specifically taking into consideration the judgment in Sant Kanwarram Education and Social Welfare Society so also Municipal Corporation of Delhi referred supra. The decision taken shall be communicated to the petitioner within a period of two weeks from the date of such decision. 7. Writ Petition is disposed of accordingly. No costs. (Raj D. Wakode, J.)
