Kandpal, learned AGA, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Shabbir @ Suhel @ Kareem Khan, who has been accused in FIR No.26 of 2013, dated 16.02.2013, under Sections 395, 397, 120B of IPC, at Police Station Sitarganj, District Udham Singh Nagar. 4. An FIR was lodged on 16.02.2013 as FIR No. 26 of 2013, at Police Station Sitarganj, District Udham Singh Nagar, against the unknown persons, with the allegation of robbery. Learned counsel for the Applicant submits that the Applicant is languishing in jail since 18.01.2026. He further submits that the Applicant has falsely been implicated in the present matter. It is also contended by the learned counsel for the Applicant that the case was instituted in the year 2013 and present Applicant is arrested in the year 2026. It is further submitted that the co-accused in the same case have been acquitted in Session Trial No.197/2013, “State Vs. Bhura”. 5. The bail application of the Applicant has been vehemently opposed by the learned State Counsel. 6. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 7. Accordingly, bail application is allowed. It is directed that the Applicant - Shabbir @ Suhel @ Kareem Khan, who has been accused in FIR No.26 of 2013, dated 16.02.2013, under Sections 395, 397, 120B of IPC, at Police Station Sitarganj, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
