The petitioners are accused in STC.No.57 and 58 of 2025 on the file of the Principal District and Sessions Court, Kanyakumari and they have filed these petitions to quash the proceedings pending against them. 2.The learned Senior Counsel appearing for the petitioners by referring to the Deputy Transport Commissioner's report dated 07.09.2021 submits that the Deputy Transport Commissioner has conducted an enquiry with regard to the very same allegations and filed a report that these transactions have been made by the persons, who have been engaged on outsourcing. However, these petitioners have been arrayed as accused without considering this report. The learned senior counsel has also pointed out that the user name and password of the VAHAN software were also available with the outsourcing employee is the report of the Deputy Transport Commissioner. However, the same has not been considered by the investigating agency while filing the final report. 3.The learned Government Advocate submits that the petitioners are the Assistant and the Regional Transport Officer and they are responsible for 2/5 https://www.mhc.tn.gov.in/judis
CRLOP(MD)No.15317 of 2026 these transactions. The user name and password for the VAHAN software have been provided only to them. In the event the officers have provided the same to some others, it is an offence. Since it is the responsibility of the petitioners, the case has been registered as against the petitioners and final report has been filed.
The petitioners have reduced the motor vehicle tax entries, created forged electronic records and thereby caused a wrongful loss to the government, which is evident from the list, which contains the vehicle details. Therefore, this is not a fit case for quashment. 4.This Court has considered the rival submissions made. 5.Though the petitioners have raised several grounds, the same can be appreciated only during the trial. Therefore, this court is not inclined to interfere with the proceedings at this stage. The petitioners are at liberty to raise all these grounds, before the trial court along with the aforementioned report of the Deputy Transport Commissioner during the defence evidence.
