Present bail application is moved by the applicant, who is in judicial custody in connection with FIR No.35 of 2025 under Section 3(5), 61(2), 317(2) and 318(4) of Bhartiya Nyaya Sanhita and Section 66 D of the Information Technology Act, 2000, Cyber Crime Police Station Rudrapur, District Udham Singh Nagar. 4. Learned counsel for the applicant submits that the present applicant has been implicated on the basis of the false and frivolous story and no specific role has been assigned to him; he is not named in the FIR; he has no criminal history. Learned counsel for the applicant placed reliance on the Notification/Circular issued by the Hon’ble Supreme Court of India. 5. Learned State counsel vehemently opposed the bail application. 6. This Court takes note that in due compliance of the strict orders issued by the Hon’ble Supreme Court time and again in matters pertaining to bails wherein strict compliance of the mandates as laid down by Hon’ble Supreme Court in number of judgments is to be followed but in the present case the same has not been done by the court below while taking remand or while deciding the bail application filed by the applicant. 7. Having heard learned counsel for the parties and considering the overall facts and circumstances of the case, this Court is of the view that applicant is entitled to be released on bail. 8. Accordingly, bail application is allowed. Let the applicant-Malkeet Singh be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned. 9.
